“On 2 August 2026, the transparency obligations under Article 50 of the EU AI Act will become applicable. This deadline remains unchanged despite the recent postponement of other implementation deadlines. A limited transitional period applies to providers of certain general-purpose AI systems that were placed on the market before 2 August 2026: the technical requirements for marking AI-generated content only become mandatory for these providers from 2 December 2026.
Companies should now assess whether and where the transparency obligations apply to them. Depending on their role as a provider or deployer, this may include AI systems that interact directly with people, generate synthetic content, use emotion recognition or biometric categorisation, as well as organisations that publish deepfakes or certain AI-generated content relating to matters of public interest.
At the same time, this milestone should serve as an opportunity to review the organisation’s overall use of AI. This includes maintaining a reliable inventory of AI applications, clearly defined responsibilities, and robust governance structures. Transparency alone is no longer sufficient once AI systems gain access to operational applications, evaluate data from multiple sources, or independently trigger process steps.
The goal is not to slow down Artificial Intelligence, but to integrate it into existing business processes in a controlled and traceable way. Companies that postpone establishing these foundations will likely face costly adjustments later and lose valuable time in advancing their AI strategy.
